Guatemalan man accused of DUI

A 37-year-old Guatemalan man was in the Gallatin County jail Wednesday on suspicion of driving while intoxicated in Belgrade.

The man, Rober Mario Pop Caal, is accused of being in the country illegally and was being held for ICE as of Wednesday.

He was arrested following an investigation that began at about 8:49 p.m. June 6. At that time, a sheriff’s deputy reportedly saw a northbound white Toyota Corolla weaving on Jackrabbit Lane near Donjo Avenue.

The Corolla crossed over the center line and fog line and was traveling 55 mph in a 45-mph zone, according to an affidavit the deputy filed in justice court. The deputy conducted a traffic stop.

“The vehicle slowed to approximately 25mph and drove to W. Jefferson before pulling over,” the affidavit reads. “The vehicle drove for approximately one mile before stopping at the Town Pump on W. Jefferson Ave. I identified the driver as the Defendant by his Guatemala ID card. I could smell the strong odor of alcohol emanating from the Defendant and I observed his eyes to be red and watery. The Defendant was not able to provide the required documents.”

Caal failed a field sobriety test and provided a breath sample that yielded a reading of 0.122 BrAC, according to the affidavit.

The deputy advised Caal be prosecuted on misdemeanor charges of DUI, driving without insurance, failing to pull over in a timely manner, and driving without ever having possessed a valid license.
