Man accused of assaulting officer, DUI

A 55-year-old California man drove drunk without a driver’s license and insurance, kicked a police officer, and tried to head butt the officer, according to allegations filed in county court.

The man, Alfonso David Crus, was arrested shortly after an investigation that began around 7 p.m. March 30. At that time, a Bozeman city police officer was dispatched for a report of a man who stumbled out of a Suburban to urinate in a ditch next to the interstate. Another officer found the Suburban in the westbound lane near exit 309, according to an affidavit the first officer filed in Gallatin County Justice Court.

The officer/affiant reported that the Suburban’s driver was identified as Cruz, who allegedly had slurred speech and couldn’t produce proof of insurance.

“At one point, I saw Cruz attempt to exit the vehicle without being asked to do so,” reads the affidavit.

The affiant allegedly obtained permission to search Cruz’s vehicle for identification and reported finding a U.S. passport.

Cruz, who had no driver’s license, failed a field sobriety test and was arrested on suspicion of DUI, according to the affidavit. Cruz allegedly provided a breath test that indicated a BAC of 0.245.

Cruz agreed to provide a blood sample, according to the affidavit. He was belligerent and disruptive at the hospital, yelling “loud and profane statements” and disturbing the peace of people in the waiting room, the affiant wrote. Cruz had to be immobilized in a restraint device after he kicked an officer in the left thigh and tried to head butt the same officer, according to the affidavit.

The affiant advised that Cruz face misdemeanor charges of disorderly conduct, driving while intoxicated for the second time, driving without a license, driving without insurance, and a felony charge of assaulting a peace officer.
