Man jailed in Belgrade on suspicion of 2 DUIs, fake IDs

A 21-year-old Mexican man wanted by the law and accused of being in the country illegally was arrested in Belgrade on suspicion of drunk driving, having been arrested over a year ago on suspicion of DUI.

The man, Jose Luis Moreno Aguilar, was in the Gallatin County Detention Center as of Monday on an ICE hold, according to county records. He was arrested after an investigation that began about 8:30 a.m. April 1 with a traffic stop. A state trooper on patrol in Belgrade reportedly saw a silver Nissan Altima with a license plate registered to someone with a warrant issued for failing to appear in court on a DUI charge.

The trooper stopped the Altima near S. Alaska Road and E. Frank Road and asked the driver for ID, according to an affidavit the trooper filed in Gallatin County Justice Court. The driver, identified as Aguilar, provided the trooper with a false name and later “admitted to lying about his name and knew he had a warrant,” the affidavit states.

Aguilar reportedly gave the trooper permission to look through his phone for a form of ID.

“While looking through his photos, I observed a photo of 3 different forms of ID,” the trooper wrote.

Aguilar’s driving privileges had been suspended for failing to appear in court, according to the affidavit. His permanent resident card “was deemed to be fraudulent by the SA Border Patrol,” according to the affidavit.

“The ID# would have belonged to someone who was born in the 1980s not 2004,” the trooper wrote.

Aguilar also reportedly had a fraudulent Social Security card; it bore his name but also a number that belonged to a Washington resident, according to the affidavit.

The trooper advised that Aguilar be prosecuted on misdemeanor charges of driving with a suspended license, displaying invalid ID, and obstructing a peace officer.

April 2025 arrest

In the case of Aguilar’s DUI charge from over a year ago, he was arrested shortly after an investigation that began about 11:24 p.m. April 25, 2025, when a sheriff’s deputy reported seeing a suspicious vehicle traveling through business parking lots in the 6200 block of Jackrabbit Lane after hours.

“Upon walking up to the vehicle, I noticed multiple open containers in the rear seat,” reads the deputy’s complaint. “The driver and passenger of the vehicle advised me they were Spanish-speaking. I then activated the ‘interpretmontana’ app for a translator. The driver was identified by his Mexico ID as Jose Luis Moreno Aguilar. The translator explained my reason for stopping out with them. I could smell a strong odor of alcohol emitting from the vehicle.”

Aguilar reportedly failed a sobriety test and was arrested, with bond set at $1,085. The complaint doesn’t state whether Aguilar was released to ICE following this 2025 arrest.

Bail bonds were denied in his pending cases, according to jail records.
